Statement in merito agli approfondimenti giudiziari in corso

Roma, 10 ottobre 2021 – Il Gruppo Barletta – in linea con gli standard di trasparenza che da sempre caratterizzano il proprio operato – intende offrire con il presente documento gli opportuni chiarimenti in ordine all’asserito coinvolgimento – del quale alcuni articoli di stampa hanno dato conto in modo del tutto parziale ed inconferente – in un’attività di indagine condotta dalla Procura di Roma a carico di soggetti e per fatti del tutto estranei al Gruppo Barletta ed alle sue attività.

In effetti, il Dott. Paolo Barletta risulta quale mero indagato in un procedimento giudiziario esclusivamente in ragione del suo ruolo formale nell’ambito della compagine societaria (come emerge nitidamente dalla contestazione provvisoria notificata il 5 ottobre u.s.). Al contempo, deve subito chiarirsi altresì che nessun membro del Gruppo Barletta è stato sottoposto ad alcun provvedimento cautelare, come pure non risultano iniziative di sorta a carico delle persone giuridiche.

Venendo ai fatti, occorre sottolineare come l’episodio che coinvolge il Gruppo Barletta sia oggetto di doveroso accertamento in ordine ad un occasionale e ben circoscritto rapporto professionale con l’Avv. Gianluca Esposito (Professore ordinario di diritto amministrativo presso l’Università “La Sapienza” di Roma), rapporto in ordine al quale, secondo gli stessi inquirenti, si impongono «gli ulteriori necessari sviluppi investigativi». Ne deriva che, da un lato, l’iscrizione di questa notizia di reato si rivela quale atto dovuto e, dall’altro lato, che essa è ancora oggetto di preliminare verifica (giacché, come si è già chiarito, l’indagine principale nasce e si sviluppa esclusivamente a carico di soggetti e per fatti non riferibili al Gruppo Barletta).

Più precisamente, il singolo segmento investigativo d’interesse riguarda l’offerta avanzata al Gruppo Barletta dal prof. Gianluca Esposito nell’autunno del 2020 avente ad oggetto prestazioni professionali per verificare la praticabilità di operazioni di finanziamento agevolato da parte di Invitalia¹ – i cosiddetti contratti di sviluppo – finalizzati a supportare alcuni investimenti turisticoricettivi che il Gruppo stava progettando nel Sud Italia, per la precisione a Maratea.

Sul punto vale la pena di ricordare come i contratti di sviluppo con Invitalia rispondano ad uno strumento normativo creato proprio per agevolare le aziende che sostengono importanti investimenti capaci di produrre significative ricadute sul piano economico-sociale; né può trascurarsi il fatto che i contratti di sviluppo prendono vita solo dopo lunghe e complesse procedure standardizzate (insuscettibili di essere omesse) che coinvolgono varie amministrazioni a più livelli (regionale e centrale) e sono soggetti a un’approfondita istruttoria di merito, sia riguardo alle caratteristiche del soggetto richiedente, sia in ordine all’investimento proposto.

Nell’ottobre del 2020, è stato quindi stipulato un regolare contratto di consulenza, in forma scritta, con il Prof. Esposito; successivamente, senza che fosse mai stata anche solo presentata alcuna richiesta di finanziamento ad Invitalia, già nei primi mesi del 2021, il Gruppo Barletta ha comunicato al prof. Esposito l’intenzione di non avvalersi di detto strumento e, conseguentemente, di voler risolvere il contratto di consulenza. Ne è derivato un contenzioso giudiziario tra il Gruppo Barletta e il professionista in questione, che è tuttora in corso, sicché ad oggi non è stata versata al consulente alcuna somma.

Quella appena illustrata è stata l’unica occasione di incontro professionale tra il prof. Esposito e il Gruppo Barletta, che – ribadiamo – si è anche risolta in un contenzioso civile tuttora in essere tra le parti e avviato già nel giugno scorso, quindi ben prima che si avesse contezza della esistenza della odierna indagine.

Va altresì ribadito che il Gruppo Barletta non solo non ha mai ricevuto alcun sostegno, in nessuna forma, da Invitalia, ma neppure l’ha mai chiesto (nel senso che fisicamente non è mai stata compilata né protocollata alcuna domanda presso Invitalia da parte del Gruppo Barletta).

Infine, il Gruppo Barletta non ha mai erogato alcuna somma per onorari o altre spettanze, sotto nessuna forma, in favore del Prof. Gianluca Esposito, né direttamente, né indirettamente; neppure è mai stato attivato qualsivoglia rapporto professionale con l’architetto Esposito (fratello del Prof. Gianluca Esposito), sicché non è mai stato né pattuito, né erogato alcun compenso nei suoi confronti.

Alla luce di tutto quanto esposto, il Gruppo Barletta – pur rispettoso del valore della libertà di stampa e d’informazione – provvederà a tutelare con incisività la propria reputazione con ogni strumento utile, al fine di stigmatizzare e impedire impropri accostamenti e strumentalizzazioni di ogni tipo.

Il Gruppo, peraltro, è disponibile ad offrire qualunque ulteriore chiarimento a tutti i suoi stakeholder e alla stampa, al fine di ridurre il grado di incertezza su una questione che, in attesa di essere definita dall’autorità giudiziaria, merita anche sul piano sociale e mediatico una puntuale e veritiera ricostruzione, alla quale questo documento confidiamo possa dare un sostanziale contributo.

Rome, 10^th October 2021 – The Barletta Group has always placed at the forefront its integrity and transparency as a key characteristic of its strategy. This document intends to offer the appropriate clarifications concerning the alleged involvement of the Group – that has been reported and portrayed by some press articles in a completely partial and irrelevant perspective – in an investigation conducted by the Prosecution Service of Rome with reference to facts completely unrelated to the Barletta Group and its activities.

Indeed, Mr. Paolo Barletta is under investigation in a judicial proceeding exclusively due to his formal role within the corporate structure of the Barletta Group (as it clearly emerges from the provisional charge served on October 5^th, 2021). It is essential to immediately precise that no other members of the Barletta Group have been subject to any precautionary measures, and there are not any initiatives of any kind against the companies.

With regards the object of the abovementioned proceeding, it must be stressed out that the fact temporary alleged to the Barletta Group is referred to an occasional and well-circumscribed professional relationship with Mr. Gianluca Esposito (Professor of Administrative Law at the University of Rome “La Sapienza”) and that, according to the proceeding judiciary authority itself, “further necessary investigative acts” must be carried out with reference to such relationship.

Therefore, it must be concluded, on one hand, that the registration of Mr. Barletta among the subjects under investigation represents only a necessary act, on the other hand, that such investigations are just preliminary, since – as already mentioned – the main investigation concerns exclusively other subjects and it is not related to the Barletta Group.

More in the specific, the investigation regarding the Barletta Group concerns the offer made in autumn 2020 to the latter by Professor Gianluca Esposito and related to the professional services Professor Esposito would have provided in order to verify the feasibility of facilitating finance operations by Invitalia¹. These operations are the so-called development contracts and would be aimed to support certain tourist accommodation investments that the Group intended to apply in the south of Italy, specifically in the town of Maratea.

In this respect, the development contracts with Invitalia are in compliance with the normative tool elaborated in order to facilitate companies and to support relevant investments able to produce significant economic and social benefits. It cannot be overlooked that the development contracts are established only after long and complex standardized procedures (which cannot be omitted) involving various administrative bodies at different levels (regional and central). Moreover, they are subject to in-depth due diligence procedures to verify the eligibility and the characteristics of the applicant for the proposed investment.

In October 2020, the Barletta Group and Professor Esposito signed a regular consultancy contract according to which the latter was asked to evaluate the eligibility of the Barletta Group to apply for the process. However, after that there wasn’t any request for funding submitted to Invitalia. Moreover, in the early months of 2021, the Barletta Group informed Professor Esposito of its intention not to apply for Invitalia’s funds, meaning the withdrawal of the consultancy contract and, consequently, the contract with Professor Esposito was concluded. This withdrawal has caused a legal dispute between the Barletta Group and Professor Esposito, that is still ongoing so that no payment has been made from the Barletta Group to the abovementioned consultant.

It is important to clarify that Professor Esposito professionally met the Barletta Group only once.

We reaffirm that a civil litigation is still ongoing between the parties, and this started last June. Hence, this occurred a long time before the instatement of the present investigation.

It is important to reiterate that the Barletta Group has never received any support, in any form from Invitalia, or even has requested anything to Invitalia (meaning that no application has been filed with Invitalia by the Barletta Group).

Finally, the Barletta Group has never paid any sum for fees or other entitlements, in any form, to Professor Gianluca Esposito, either directly or indirectly, or even a professional relationship has been established with the architect Esposito (Professor Gianluca Esposito’s brother), therefore, no compensation has ever been agreed upon or paid to him.

Giving the above, the Barletta Group – while respecting the value of freedom of the press and information – will continue to protect its reputation in every possible way in order to denounce and prevent improper manipulations of any kind.

In conclusion, the Barletta Group is willing to offer any necessary clarification and/or information to all its stakeholders and to the press; with the intention to reduce the degree of uncertainty on an issue that, waiting to be defined by the judicial authority, even from a social and mass-media standpoint deserves a precise statement of truthful reconstruction, that we trust to have offered through this document.
